Terms and conditions governing the use of our home services management platform

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and WeCazza ("Company," "we," "us," or "our"), an operating business located in Atlanta, Georgia, USA. By accessing or using the WeCazza platform (available at https://wecazza.com and https://app.wecazza.com), including our website, mobile application, and related services (collectively, the "Service"), you agree to be bound by these Terms.
If you are using the Service on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to that entity.

WeCazza is a Software-as-a-Service (SaaS) platform designed for home service businesses, including but not limited to cleaning services, landscaping, pet sitting, pressure washing, and handyman services. Our platform provides:
The Service is intended for use by business owners, their employees, and their end-customers who interact with booking widgets, customer portals, and payment pages.
WeCazza offers the following subscription plans:
We offer a 15-day free trial that includes access to all Premium features. A valid credit card is required to begin your free trial. If you do not cancel before the end of your free trial period, you will automatically be charged for your selected subscription plan.
Payment processing is handled through Stripe Connect. By using our payment features, you agree to Stripe's terms of service. WeCazza may receive a commission on transactions processed through the platform.
We reserve the right to modify our pricing at any time. Price changes will not affect your current subscription period but will apply to subsequent renewals. We will provide at least 30 days' notice of price increases.
To use the Service, you must create an account by providing accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

You retain ownership of all data you input into the Service ("Customer Data"). We do not claim ownership rights to your Customer Data.
By using the Service, you grant us the right to process your Customer Data solely to provide the Service and as described in our Privacy Policy.
We implement appropriate technical and organizational measures to protect your data, but we cannot guarantee absolute security. You acknowledge that data transmission over the internet carries inherent risks.
You may export your Customer Data at any time through the Service interface. Upon termination of your account, we will provide you with a reasonable opportunity to retrieve your data.
The Service, including all software, algorithms, artificial intelligence models, user interfaces, and related intellectual property, is owned by WeCazza and protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. This license terminates upon termination of your account.
You retain ownership of content you create using the Service. By using the Service, you grant us a non-exclusive license to use, modify, and display such content solely to provide the Service.
We strive to maintain high service availability but do not guarantee uninterrupted access to the Service. We provide the Service on a "best effort" basis and do not offer Service Level Agreement (SLA) guarantees at this time.
We may perform scheduled maintenance that temporarily interrupts Service availability. We will attempt to provide reasonable advance notice of scheduled maintenance.
Support is provided via email at support@wecazza.com. Response times and support levels vary by subscription plan.
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of your current billing period.
You may upgrade your plan at any time, with changes taking effect immediately. Downgrades take effect at the end of your current billing period, and feature access may be immediately restricted to match your new plan's limitations.
All subscription fees are non-refundable except as required by applicable law or as specifically provided in these Terms. If you cancel during your free trial period, you will not be charged. Refunds may be considered on a case-by-case basis for exceptional circumstances at our sole discretion.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WECAZZA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
You agree to indemnify, defend, and hold harmless WeCazza and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. Arbitration proceedings shall take place in Atlanta, Georgia.
You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as part of a class action or representative proceeding.
We may modify these Terms at any time by posting the updated Terms on our website. Changes will be effective upon posting unless otherwise specified. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
This Section sets forth additional obligations governing your use of SMS messaging, the Customer Portal, the Online Booking widget, and automated communications. It supplements (and does not replace) Sections 6 (Acceptable Use) and 13 (Indemnification).
If you enable the SMS feature, you must first complete the in-app onboarding wizard and check the box affirming that:
WeCazza enforces these obligations at the platform level via server-side gates. However, your attestation is not contingent on those gates functioning, and you remain solely responsible for compliance.
Sending SMS messages to United States recipients via the Service requires registration of your business with the carrier-mandated A2P 10DLC system. The brand is registered to your organization's legal name, federal Employer Identification Number (EIN), and business address. By submitting registration through the Service, you authorize WeCazza to transmit that information to Twilio, Inc. and to United States wireless carriers for verification. You represent that the information you provide is true, complete, and current.
You may not initiate an SMS message to any customer unless that customer has given you prior express written consent within the meaning of 47 C.F.R. § 64.1200. Consent must be obtained verbally, in writing, through a signed service agreement, or through an online form bearing a clear disclosure that consent is not a condition of purchase. You must maintain records of how and when consent was obtained. The Service provides an audit log to assist with such recordkeeping, but the legal sufficiency of the consent is your responsibility.
Customers may revoke consent at any time by replying with STOP, UNSUBSCRIBE, CANCEL, END, QUIT, or equivalent. The Service automatically processes such replies, suppresses further messages, and sends a confirmation. Customers who reply START re-subscribe. You may not attempt to circumvent or override these mechanisms, including by manually marking a customer's consent flag after they have revoked it without obtaining fresh express consent.
You will not use the SMS feature to transmit content that is: (i) marketing or promotional in nature without separate written marketing-specific consent; (ii) related to gambling, firearms, cannabis, sexually explicit material, debt collection, or other categories restricted by carrier guidelines; (iii) unlawful, threatening, harassing, defamatory, or fraudulent; or (iv) misleading as to its sender. Every outgoing message is prefixed with your organization's identifying name; you may not request or attempt to send messages without this identifier.
SMS messages sent through the Service are subject to per-message fees in addition to your subscription. Fees are billed via Stripe metered billing under your existing subscription. Carrier surcharges, regulatory fees, and overage charges may apply and are passed through at cost plus WeCazza's stated markup. Failure to pay metered SMS charges may result in suspension of the SMS feature.
WeCazza monitors STOP-reply rates per organization. If your organization's STOP-reply rate exceeds five percent (5%) of messages sent in any rolling twenty-four (24) hour period (with a minimum sample of fifty (50) messages), the SMS feature is automatically suspended for your organization pending review. Reactivation requires manual review by WeCazza.
The Service includes an authenticated Customer Portal that you may invite your customers to access. By inviting a customer to the Portal, you represent that the customer has consented to receive email and, where applicable, SMS communications related to the services you provide. Customers access the Portal via a magic link sent to their email address; WeCazza does not store customer passwords.
You may not bulk-import customer records and send Portal invitations to those records without their prior consent to receive email contact. The Service requires explicit confirmation of such consent before transmitting bulk invitations.
The Service includes an Online Booking widget that allows prospective and existing customers to submit service requests to your organization. A booking submission is a request, not a confirmed appointment, and creates no obligation on WeCazza or on you to accept it. You are responsible for reviewing, accepting, proposing alternatives to, or declining each request through the administrative interface. Communications generated by the Online Booking flow are subject to the same consent and content rules set forth in this Section.
If your organization completes Stripe Connect onboarding, customers may pay invoices directly through the Customer Portal. Payments are processed via Stripe Connect's destination-charge mechanism; funds are transferred directly to your connected Stripe account, less WeCazza's platform fee. WeCazza does not hold customer funds. Your use of Stripe Connect is governed by Stripe's Connected Account Agreement in addition to these Terms.
The Service automatically dispatches certain communications on a recurring schedule, including: appointment reminders, post-service review requests, retention/win-back nudges to customers without a recent service event, and document-status notifications. These communications are sent on your behalf and counted against your communication quotas. You may disable individual automated channels in Settings.
By using the WeCazza Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
